These Terms of Service (the “Terms”) govern your access to and use of PokéForce, including the game client and servers, pokeforce.org, community features, Secretary Yuki, and the PokéForce Discord Rich Presence integration (collectively, the “Services”). The Services are operated by Rune Force Studios (“we,” “us,” or “our”).
By creating an account, accessing, or using any Service, you agree to these Terms. If you do not agree, do not use the Services.
1. Eligibility and accounts
You must meet the minimum age required to use Discord and the minimum age required by the laws where you live. If you are not legally able to agree to these Terms, a parent or legal guardian must agree on your behalf.
You must provide accurate account information, keep your credentials secure, and promptly tell us about suspected unauthorized access. You are responsible for activity performed through your account. Accounts, access credentials, characters, and virtual property may not be sold, shared, or transferred unless we expressly permit it.
2. Acceptable use
You may use the Services only for their intended purposes and in accordance with applicable law. You may not:
- harass, threaten, impersonate, exploit, or abuse another person;
- cheat, automate gameplay, exploit defects, manipulate the economy, or evade enforcement;
- disrupt the Services, introduce malicious code, scrape restricted data, or attempt unauthorized access;
- reverse engineer or redistribute protected portions of the Services except where applicable law expressly permits it;
- submit illegal, infringing, deceptive, hateful, sexually exploitative, or otherwise harmful content;
- use Secretary Yuki, Rich Presence, or another integration in a way that violates Discord’s terms or policies; or
- use the Services for unauthorized commercial activity.
Community rules and event-specific rules form part of these Terms when they apply to your use.
3. User content
You retain any ownership rights you have in content you submit, including forum posts, messages, support material, bug reports, images, and contest entries. You grant us a non-exclusive, worldwide, royalty-free license to host, copy, process, adapt, display, and distribute that content as reasonably necessary to operate, secure, moderate, promote, and improve the Services.
For cosmetic, graphical, artistic, design, or similar contests, this license also permits us to use, modify, and publish the submission in PokéForce, on our website, Discord communities, social media, and promotional material. Unless the event rules say otherwise, you retain ownership of your original work. You confirm that you have the rights needed to submit the content.
4. Virtual items and game economy
Characters, items, currencies, progression, and other virtual content are licensed features of the Services. They are not legal tender, have no guaranteed real-world value, and do not confer ownership in the underlying software or data. We may adjust, rebalance, remove, or restore virtual content to operate the game, correct defects, protect players, or preserve game balance.
5. Secretary Yuki and Discord Rich Presence
Secretary Yuki provides community functions such as experience and role progression, contest or event submissions, staff message forwarding, and bug-report synchronization. PokéForce Rich Presence displays selected game activity on a player’s Discord profile when Discord and activity sharing are enabled. Discord remains a third-party service governed by Discord’s own terms and policies.
We may change, suspend, or discontinue individual bot commands, integrations, or presence fields at any time.
6. Intellectual property and fan-project notice
The original software, website, systems, designs, documentation, and other original material created for the Services are owned by or licensed to Rune Force Studios. These Terms do not transfer those rights to you.
PokéForce is an independent, fan-made project. Pokémon and related trademarks and intellectual property belong to their respective owners. PokéForce is not affiliated with, sponsored by, or endorsed by Nintendo, Game Freak, Creatures Inc., or The Pokémon Company.
7. Availability, testing, and changes
The Services may contain unfinished, experimental, or beta features. We do not guarantee that the Services will always be available, uninterrupted, secure, or error-free. Features, content, progression, and availability may change without notice where reasonably necessary.
8. Moderation, suspension, and termination
We may remove content or restrict, suspend, or terminate access when we reasonably believe these Terms, community rules, platform policies, or applicable law have been violated, or where action is needed to protect users or the Services. You may stop using the Services at any time and may request account deletion through our support system.
9. Privacy
Our Privacy Policy explains what information we process, why we use it, how it is shared and retained, and how to make a privacy request.
10. Third-party services
The Services may rely on or link to third parties, including Discord, GitHub, infrastructure, email, security, and network providers. We do not control and are not responsible for their independent services, availability, or policies.
11. Disclaimers
To the maximum extent permitted by law, the Services are provided “as is” and “as available,” without warranties of merchantability, fitness for a particular purpose, non-infringement, or uninterrupted availability. Nothing in these Terms excludes warranties or consumer protections that cannot lawfully be excluded.
12. Limitation of liability
To the maximum extent permitted by law, Rune Force Studios and its contributors will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, access, opportunity, or profits arising from the Services. Nothing limits liability where doing so is prohibited by law.
13. Changes to these Terms
We may update these Terms as the Services or legal requirements change. We will post the updated version here and revise the effective date. Material changes may also be announced through the website or community channels. Continued use after the updated Terms take effect means you accept them.
14. Governing law
These Terms are governed by the laws of British Columbia and the applicable federal laws of Canada, without regard to conflict-of-law rules, except where mandatory law in your jurisdiction provides otherwise.
